Terms of Service

Effective Date: April 6, 2026

These Terms of Service ("Terms") govern your access to and use of SmartAF™ and related services (the "Service") operated by Automation Edit LLC ("Automation Edit," "we," "us," or "our"). By creating an account or using SmartAF, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Service Description

SmartAF is an AI-powered knowledge base platform that enables you to:

• Upload documents, connect Google Drive (read-only), and connect Notion (read-only) to build a personal, searchable knowledge base ("Brain")
• Query your Brain through Claude AI via the SmartAF MCP connector, which provides your documents as context during conversations
• Browse, install, and publish content on the SmartAF Marketplace, including IQ Boosts (expert knowledge packages) and Skills (instruction frameworks)
• Manage your documents, connectors, and account through the SmartAF web interface

SmartAF enhances your AI interactions by making your own knowledge available to Claude. It is not a chat application — all question-and-answer interactions occur through Claude via the MCP connector.

2. Account Registration

To use SmartAF, you must create an account. By doing so, you agree that:

• You are at least 18 years of age
• You will provide accurate and complete registration information
• You are responsible for maintaining the security of your account credentials
• You are responsible for all activity that occurs under your account
• You will notify us immediately at support@automationedit.ai if you suspect unauthorized access to your account

Accounts are authenticated through AWS Cognito using Google Sign-In or email registration. Each account is assigned to an organization for data isolation.

3. Subscription Plans and Billing

Plans

SmartAF offers the following subscription tiers:

Billing

• All payments are processed by Stripe. By subscribing, you also agree to Stripe's Terms of Service
• Subscriptions renew automatically each month unless canceled
• You may change or cancel your plan at any time through the billing portal. Changes take effect at the start of the next billing cycle
• We reserve the right to adjust pricing with at least 30 days' notice. Existing subscriptions will honor their current rate until the next renewal after the notice period

Refunds

Refunds are handled on a case-by-case basis. If you believe you were charged in error or are unsatisfied with the Service, contact support@automationedit.ai within 14 days of the charge.

4. Acceptable Use

You agree not to use SmartAF to:

• Upload, store, or distribute content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable
• Upload content that infringes on the intellectual property, privacy, or other rights of any third party
• Attempt prompt injection, jailbreaking, or any technique designed to manipulate AI behavior beyond its intended function
• Attempt to access another user's data, account, or organization
• Reverse-engineer, decompile, or attempt to extract the source code of the Service
• Circumvent usage limits, rate limits, or other technical restrictions
• Use the Service for automated scraping, bulk data extraction, or any purpose not consistent with individual or team knowledge management
• Distribute malware, viruses, or any code intended to damage or surveil
• Use the Service in violation of any applicable law or regulation

We reserve the right to suspend or terminate accounts that violate these restrictions, with or without prior notice depending on the severity of the violation.

5. Your Content

Ownership

You retain full ownership of all content you upload to or create within SmartAF. We do not claim any intellectual property rights over your documents, text, or other materials.

License to Operate

By uploading content, you grant Automation Edit a limited, non-exclusive license to store, process, chunk, embed, index, and serve your content solely for the purpose of operating the Service on your behalf. This license terminates when you delete the content or your account.

Your Responsibility

You are solely responsible for the content you upload. You represent that you have the necessary rights to upload and process all content you provide to SmartAF.

Content Removal

We reserve the right to remove content that violates these Terms, applicable law, or the rights of others. When reasonably practicable, we will notify you before or promptly after removing content.

6. Marketplace

Overview

The SmartAF Marketplace allows users to publish IQ Boosts and Skills that other users can install. IQ Boosts are expert knowledge packages priced between $5 and $100. Skills are instruction frameworks offered for free.

Publisher Responsibilities

By publishing content to the Marketplace, you represent and agree that:

• You own or have the right to distribute all content in the package
• The content is original and does not infringe any third party's intellectual property rights
• The content does not contain malicious instructions, prompt injection attempts, or harmful directives
• You will not publish misleading, deceptive, or fraudulent content
• All published content is subject to review and approval by Automation Edit administrators before it becomes available

Publisher License

By publishing to the Marketplace, you grant Automation Edit and installing users a non-exclusive, worldwide license to store, index, synthesize, and serve your content through the SmartAF platform. You retain ownership of the original content.

Content Synthesis

Marketplace content undergoes AI synthesis via AWS Bedrock before being delivered to installing users. Raw publisher content is never directly exposed. This synthesis is a core feature of the platform and applies to all marketplace content.

Review and Removal

All marketplace submissions undergo admin review before publishing. We reserve the right to reject, remove, or delist any marketplace content at our sole discretion, including for violation of these Terms, quality concerns, or user complaints.

Anti-Spam

To maintain marketplace quality, publishers are limited to one pending submission at a time with a 24-hour cooldown between submissions.

7. Intellectual Property

SmartAF Platform

The SmartAF platform, including its design, code, algorithms, features, branding, and documentation, is the intellectual property of Automation Edit LLC. SmartAF™ is a trademark of Automation Edit LLC. Nothing in these Terms grants you any rights to our intellectual property except the limited right to use the Service as described herein.

User Content

You retain all rights to content you upload. See Section 5 for the license you grant us to operate the Service.

Marketplace Content

Publishers retain ownership of their marketplace content. Installers receive a non-exclusive, non-transferable license to access marketplace content through SmartAF for personal or business use. Installers may not extract, redistribute, or resell marketplace content.

Feedback

If you provide feedback, suggestions, or ideas about SmartAF, you grant us a perpetual, irrevocable, royalty-free license to use that feedback to improve the Service without any obligation to you.

8. Third-Party Integrations

SmartAF integrates with third-party services including Google Drive, Notion, Stripe, AWS, and Cloudflare. By connecting these services:

• You authorize SmartAF to access your data on those platforms as described in our Privacy Policy
• You acknowledge that third-party services are governed by their own terms and privacy policies
• SmartAF accesses Google Drive and Notion in read-only mode. We never modify, create, or delete content in your connected accounts
• You may disconnect any integration at any time, which immediately deletes the associated OAuth tokens

9. Data Privacy and Security

Your privacy is important to us. Our collection, use, and protection of your data is governed by our Privacy Policy, which is incorporated into these Terms by reference. Key commitments include:

• All data is scoped to your organization with strict multi-tenant isolation
• We never sell your data or share documents between organizations
• We never use your documents to train AI models
• Security measures include HTTPS, JWT authentication, WAF protection, input validation, and rate limiting

10. Service Availability

We strive to provide reliable, uninterrupted access to SmartAF, but we do not guarantee any specific level of uptime or availability. The Service is provided on a "best effort" basis.

• We may perform scheduled maintenance that temporarily interrupts the Service, and will provide advance notice when reasonably possible
• We are not liable for downtime caused by factors beyond our reasonable control, including AWS outages, network issues, or force majeure events
• We reserve the right to modify, suspend, or discontinue features of the Service at any time. For material changes, we will provide at least 30 days' notice

11. Termination

By You

You may cancel your subscription at any time through the billing portal. Your access continues until the end of your current billing period. To fully delete your account and all associated data, contact support@automationedit.ai.

By Us

We may suspend or terminate your account if:

• You violate these Terms or our Acceptable Use policy
• You engage in activity that harms the Service, other users, or our infrastructure
• Your account has been inactive for an extended period (we will notify you before any deletion)
• Required by law or legal process

For non-urgent violations, we will make reasonable efforts to notify you and provide an opportunity to remedy the issue before termination.

Effect of Termination

Upon termination, your right to use the Service ceases. We will delete your data in accordance with our Privacy Policy. Sections that by their nature should survive termination (including Intellectual Property, Limitation of Liability, Indemnification, and Governing Law) will continue to apply.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WITHOUT LIMITING THE FOREGOING, AUTOMATION EDIT DOES NOT WARRANT THAT:

• The Service will be uninterrupted, error-free, or secure
• Search results or AI-generated content will be accurate, complete, or reliable
• The Service will meet your specific requirements
• Any defects will be corrected in a specific timeframe

AI-powered search and synthesis may produce inaccurate or incomplete results. You are responsible for reviewing and verifying any information obtained through SmartAF before relying on it for business decisions.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AUTOMATION EDIT LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO AUTOMATION EDIT IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

THESE LIMITATIONS APPLY REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF AUTOMATION EDIT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

14. Indemnification

You agree to indemnify, defend, and hold harmless Automation Edit LLC and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Service
• Content you upload, publish, or distribute through SmartAF
• Your violation of these Terms
• Your violation of any rights of a third party

15. Modifications to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through a prominent notice on the Service at least 30 days before the changes take effect.

Your continued use of SmartAF after the updated Terms become effective constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service and may cancel your subscription.

16. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Texas. You consent to the personal jurisdiction of such courts.

Before initiating any formal legal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiation for a period of at least 30 days.

17. General Provisions

• Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Automation Edit regarding the Service
• Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions continue in full force and effect
• Waiver. Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision
• Assignment. You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations in connection with a merger, acquisition, or sale of assets
• No Agency. Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and Automation Edit
• Notices. We may send notices to the email address associated with your account. You may send notices to support@automationedit.ai
• Force Majeure. Neither party is liable for failure to perform obligations due to causes beyond reasonable control, including natural disasters, war, terrorism, pandemics, government actions, or infrastructure failures
